These Terms of Use (“Terms”) govern your use of the CaliStart 21 website and your purchase and use of the CaliStart 21 digital guides (the “Products”). The website and Products are provided by Insight Agência de Marketing LTDA, a company organized under the laws of Brazil, CNPJ 54.884.128/0001-94, SES Quadra 13, Lote 11, Sobradinho, Brasília-DF, 73020-413, Brazil (“CaliStart 21”, “we”, “us”). Contact: support@calistart21.online.
By buying or using the Products you agree to these Terms. If you do not agree, do not buy or use them.
1. What you are buying
The Products are downloadable PDF files in English, sold together as one set: CaliStart 21, CaliStart 42 (Phase 2), CaliStart 63 (Level 2, Intermediate), CaliStart 84 (Level 3, Advanced), the Focus Pack, The Simple Eating Guide and the Printable Pack. The set is a one-time purchase. There is no subscription, no free trial that converts to a paid plan, and no automatic renewal. The price shown at checkout is the total price for the Product, before any sales tax that applies where you live.
When a launch or promotional price is shown next to a regular price, the regular price is the price we charge for the same set when the promotion ends.
2. Payment and delivery
Payments are processed by Hotmart, which may act as the merchant of record and reseller of the Products. Its own terms and privacy policy also apply to your purchase. After payment you receive a download link on screen and by email to the address you gave at checkout. If the email does not arrive within an hour, check your spam folder and then contact support@calistart21.online.
3. Who can buy
You must be at least 18 years old to buy the Products.
4. Health and safety
The Products are general fitness and wellness information. They are not medical advice, diagnosis or treatment, and they are not a personalized exercise or nutrition plan. We are not your doctor, physical therapist, dietitian or personal trainer.
- Consult your physician before starting this or any exercise or eating program, especially if you are pregnant or recently gave birth, have a heart, blood pressure, joint, bone or balance condition, have an injury, take medication, or have been inactive.
- Stop exercising immediately and seek medical attention if you feel chest pain or pressure, dizziness, faintness, unusual shortness of breath, or sharp or sudden pain.
- You are responsible for exercising in a safe space, on a non-slip surface, and for checking that any chair, step or other object you use is stable.
Exercise carries a risk of injury. You take part voluntarily and at your own risk.
5. No promise of results
We do not promise or guarantee any specific result, including weight loss, muscle gain, a change in appearance, or any result within any period. Results vary from person to person and depend on factors outside our control, such as your starting point, consistency, sleep, nutrition and health.
6. Refunds
You can ask for a refund within 7 days of purchase. The Refund Policy explains how.
7. License and permitted use
When you buy a Product we grant you a personal, non-exclusive, non-transferable license to download it, keep copies on your own devices and print it for your own use. You may not resell, share, publish, upload or distribute the Product or any part of it, or use it to create a competing product. All rights not expressly granted are reserved.
8. Intellectual property
The text, design and layout of the Products and website belong to us or our licensors. The people shown in photographs are models. They are not customers, trainers or endorsers of CaliStart 21.
9. Disclaimer of warranties
The website and Products are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any personal injury or health problem, arising from your use of the Products or website. Our total liability for any claim relating to a Product is limited to the amount you paid for that Product. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Governing law and disputes
These Terms are governed by the laws of Brazil, and the courts of Brasília, Federal District, Brazil, have jurisdiction over disputes about them. Before starting any formal claim, please contact us at support@calistart21.online so we can try to resolve it directly. Nothing in these Terms removes consumer protections you have under the mandatory law of the place where you live, including your right to bring a claim in your local courts where that law gives it to you.
12. Changes
We may update these Terms. The version in force on the date of your purchase applies to that purchase. We will post the updated version on this page with a new “Last updated” date.
